On December 10, 2020, I discussed recent land use law developments at the Pace University Elisabeth Haub School of Law's Land Use Law Center's 19th Annual Alfred B. DelBello Land Use and Sustainable Development Conference. I spoke on a case pending before the U.S. Supreme Court on the takings issue, zoning enforcement including having to deconstruct completed buildings, and the intractable issue of what is art and free speech, and what is merely junk or crude expression. U.S. Supreme Court and clarification of the standards for regulatory takings
Just filed this Friend of the Court brief with the U.S. Supreme Court urging them to take a case concerning the tests for inverse condemnation. It's an important opportunity for the Court to resolve the problems with the current rules as interpreted by the courts and argued by the litigants.
